Waiver & Release of Liability

This is a release of liability and waiver of certain legal rights in consideration for participating in the activities of fishing and kayaking.  By signing the waiver, you are consenting to waiving the legal rights enumerated below.

I acknowledge that fishing and kayaking have inherent risks, hazards, and dangers for everyone, that cannot be eliminated.  I understand that these risks, hazards, and dangers include, without limitation:

1.        Water hazards in boating and wading in rivers and lakes, including the risk of drowning.

2.       Hiking in rugged country.

3.       Injuries from fishing equipment, as well as, other participants.

4.       Encounters with wildlife, animals, and insects.

5.       Temperature extremes.

6.       Inclement weather conditions, and the unavailability of immediate medical attention while on the water.

I understand the risks, hazards, and dangers of boating and kayaking, and have had the opportunity to discuss them with your guide.  I understand that these activities may require good physical conditioning and a degree of skill and knowledge.  I believe that I have the good physical conditioning, and the degree of skill and knowledge necessary for me to engage in these activities safely.  I understand that I have certain responsibilities, and am expected to behave in a safe and responsible manner.  My participation in this activity is purely voluntary.  No one is forcing me to participate, and I elect to participate in spite of the risks.  I am voluntarily using the services of Ron’s Fishing Adventures, LLC with full knowledge of the inherent risks, hazards, and dangers involved, and hereby assume and accept any and all risks of injury, paralysis, or death.

Lastly, I, for myself, my heirs, successors, executors, and subrogates, hereby knowingly and intentionally waive and release, indemnify and hold harmless Ron’s Fishing Adventures, LLC, their directors, officers, agents, employees, and volunteers from and against all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with my participation in the activity, including, but not limited to; negligence of any kind or nature, whether foreseen or unforeseen, arising directly, or indirectly, out of any damage, loss, injury, paralysis, or death to me, or my property, as a result of my engaging in these activities, or the use of these services, or equipment, whether such damage, loss, injury, paralysis, or death results from the negligence during fishing, kayaking, or some other cause.  I, for myself, my heirs, my successors, executors, and subrogates, further agree not to sue Ron’s Fishing Adventures, LLC as a result of any injury, paralysis, or death suffered in connection with my use and participation in the activities of fishing and kayaking.

Media Release

I,_________________________, grant permission to Ron’s Fishing Adventures to use my image (photographs and/or video) for use in media publications, including:

-Videos     -Emails     -Magazines     -Websites     -Facebook     -Instagram     -Other General Publications

I hereby waive any right to inspect or approve the finished photographs or electronic matter that may be used with them now, or in the future, whether that use is known to me or unknown, and I waive any right to royalties, or other compensation, arising from, or related to the use of the images.

I HAVE CAREFULLY READ, CLEARLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT.
